The Business Banking Legal team provides high value, strategic legal assistance to CommBank’s business banking and share trading businesses.  The team benefits from a strong legal support base and a wealth of expertise as part of CommBank’s large in-house legal function.

Do work that matters:

We are looking for a Legal Counsel or Senior Legal Counsel with 6+ years’ post-admission experience (PQE), strong commercial legal skills and a history of experience in banking and finance law and who is comfortable operating independently, including with senior management, and has a continued passion for learning and development.

You will provide strategic, practical legal advice and have high-level analytical and critical legal decision-making capabilities to assist CommBank in attaining strategic goals in a safe and customer-focussed way.

We are a team of highly skilled lawyers supporting a wide range of products and stakeholders with humour and humility.  Collaboration is key to our team’s success.

We are looking for a commercially focussed lawyer who is open to cultivating skills to assist in the variety of matters we support. 

The work is varied and may include assisting with:

  • General banking and financial services advice in relation to business banking transactions, lending products and security

  • Advising in relation to measures to prevent, detect and disrupt scams and complex customer complaints

  • Regulatory matters impacting CommBank’s Business Banking businesses, including projects implementing regulatory change, breach advices, regulatory engagements and remediation

  • New product development, service innovation and enhancements, including data analytics, emerging technologies, AI, etc.

  • Advising in relation to equity securities, derivatives and other exchange-traded products, including initial offerings and placements

  • Terms for standard form or bespoke (for large institutional clients) customer contracts

  • Contractual negotiations with referrers, intermediaries, brokers, service providers, agents or other counterparties

  • Identifying opportunities to simplify relevant frameworks, policies and processes to optimise effectiveness and efficiency and better manage legal risk across the business bank

We’re interested in hearing from people who have:

  • A current Australian practising certificate and 6+ years of relevant PQE

  • Ideally at least 4+ years’ experience in private practice at a top tier law firm

  • Excellent technical legal skills, including the ability to quickly grasp, negotiate and resolve issues in complex matters and a willingness to continue to develop your areas of expertise

  • Sound knowledge of Australian credit and financial services laws and current issues applying to banking but with a focus on business banking

  • Experience with advising on projects implementing regulatory change

  • The ability to carefully consider, negotiate and drive to completion complex legal issues and projects

  • The ability to operate independently, build excellent relationships with a range of stakeholders, ensure high levels of stakeholder management and clearly communicate on complex legal issues

  • A team-oriented outlook, unquestioned ethics and integrity, sound judgment and humility and a willingness to learn and do new things

  • Experience in retail equity trading, market integrity rules and operating rules desirable
